- Give notice, or go to court. Under full authority, the attorney sends a Notice of Proposed Action. Section 10585 requires it to state the sale price and the commission. Section 10586 requires delivery at least 15 days before the action date, and under section 10589 a written objection moves the sale under court supervision. Under limited authority, the sale goes to a confirmation hearing. Section 10311 lets another buyer overbid there by at least 10 percent on the first $10,000 of the original bid and 5 percent on the rest, and the court may decline every offer and order a new sale.
- Close escrow. Title passes once the required step is complete.
